These Terms of Service (the “Terms”) govern your access to and use of Elpha Club, operated by Future Nostalgia Studios Inc, 2261 Market Street STE 5610, San Francisco, CA 94114, United States (“we,” “us,” “Elpha Club”). By creating an account, subscribing, or otherwise using the platform you agree to these Terms.
1. The service
Elpha Club provides creators with a public microsite, forms and inbox, mailing-list and email automation tools, a booking and scheduling system with Google Calendar integration, courses, and analytics. The fee for the service is published on /pricing.
2. Your account
You're responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us promptly if you suspect unauthorised access.
3. Your content
You retain ownership of everything you publish on your microsite — your bio, products, reviews, mailing-list content, form questions, and booking configurations. You grant us a limited licence to display and deliver this content on the platform while your subscription is active.
4. Visitor data
When visitors interact with your microsite — subscribing to your mailing list, submitting a form, or booking a call — you are the data controller for their personal data and we act as your data processor. You are responsible for obtaining appropriate consent from your visitors and for complying with applicable data protection laws. See our Privacy Policy for how we handle data as a processor.
5. Third-party integrations
Certain features rely on third-party services. When you connect your Google Calendar, you authorise us to read your calendar events for availability checking and to create, update, and delete events for bookings. Your use of Google services is also subject to Google's Terms of Service. You can disconnect third-party integrations at any time from your dashboard settings.
6. Acceptable use
You agree not to use the platform to publish content that's unlawful, infringing, harassing, or otherwise harmful. We reserve the right to suspend or terminate accounts that breach this clause.
7. Billing and cancellation
Subscriptions are billed monthly in advance. You can cancel at any time from your billing settings; your microsite stays live until the end of the current billing period and then goes offline. See /refunds for our refund policy.
8. Termination
Either party may terminate this agreement at any time. On termination your microsite goes offline, your dashboard becomes inaccessible, and we retain your data for 30 days before deletion. Third-party connections (Google Calendar, etc.) are revoked immediately.
9. Disclaimers and liability
The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email at least 30 days before they take effect.
